Introduction

This research guide includes materials available at the Cracchiolo Law Library at the James E. Rogers College of Law, and some online resources. It is designed for lesbian, gay, bisexual, and transgender (LGBT) members of the community seeking information related to LGBT legal issues generally, family law, estate planning, and employment discrimination.

General LGBT Legal Resources

  • Homosexuality and the Law: a Dictionary by Chuck Stewart (ABC-CLIO 2001). Location: KF 4754.5 .A68 S74 2001 (Law). Literally organized as a dictionary, this book discusses many different words, phrases, cases, concepts, organizations, and events relating to homosexuality and the law. While seven years old, this can serve as a starting point especially where a person only has a word or phrase to work with.
  • A Legal Guide for Lesbian and Gay Couples by Denis Clifford, Emily Doskow, and Frederick Hertz (17th ed., Nolo Press 2014). Location: KF 539.H47 2014 (Law Reference). Part of the Nolo press series, this is a self-help legal guide. It can assist couples with partnership/cohabitation questions, family/parenting issues, medical & financial questions, and breaking up.
  • Proceedings from the First International Conference on Transgender Law and Employment Policy (International Conference on Transgender Law and Employment Policy 1992). Location: KF 4757.5 .T73 I58 1992 (Law). This is the record of speeches and materials from the conference. It is more useful for historic research than current legal information.
  • The Rights of Lesbians, Gay Men, Bisexuals, and Transgender People: the Authoritative ACLU Guide to a Lesbian, Gay, Bisexual, or Transgender Person's Rights by Nan D. Hunter, Courtney G. Joslin, and Sharon M. McGowan (4th ed., Southern Illinois University Press 2004). Location: KF 4754.5 .Z9 H86 2004 (Law). This handbook published by the ACLU is written in a question and answer format, divided into four parts: Sexual Orientation and the State, Civil Rights in the Private Sector, Families and Schools, and Specialized Issues. While it is four years old, it still contains useful background information and is a good starting point for answering questions.
  • Sexual Orientation and Legal Rights by Alba Conte (Wiley Law Publications 1998). Location: KF 4754.5 C66 1998 (Law). This book is a legal treatise with topic headings on Employment Discrimination and Family Law, with some discussion of general rights. It is updated by supplements.
  • Sexual Orientation and the Law by Karen B. Moulding (Thomson/West 2012). Location: KF 4754.5 .S49 (Law). Also available online on WestlawNext.This is a loose-leaf legal treatise updated twice a year, with headings such as Family and Property, Civil Rights and Discrimination, Criminal, and AIDS. Various chapters under these headings address parenting, cohabitation, taxes, employment, military, immigration and juveniles among other topics. This publication also has an index and table of cases. This is a legal treatise written towards a practicing attorney representing a client dealing with the addressed issues.
  • Sexual Orientation and the Law: A Research Bibliography Selectively Annotating Legal Literature Through 2005 edited by James M. Donovan (William S. Hein & Co. 2006). Location: KF 4754.5 .A1 S49 2006 (Law). This is a thorough bibliography including books, videos, journals and symposia. The material is organized by subject with an author index in the back. It is divided into two parts: the first covers material up to September 1, 1993 and the second covers material from that date to December 31, 1995.
  • Transition and Beyond: A Legal Guide for FTM's (female-to-male transsexuals) by Spencer A. Bergstedt (Bergstedt 1997). Location: KF 4757.5 .T73 B47 1997 (Law) and Translegalities: a Legal Guide for MTF's (male-to-female transsexuals) by Spencer A. Bergstedt (Bergstedt 1997). Location: KF 4757.5 .T73 B472 1997 (Law). Both of Bergstedt's books are guides to the various steps involved in legal gender change, including state specific notes and some sample forms. The material is 10 years old, so be sure to check current state statutes and case law. However, these could provide good starting points and legal checklists.

  • The Dukeminier Awards Best Sexual Orientation Law Review Articles (UCLA School of Law). Location: 2002-2010 available on Hein Online; 2002-present available from UCLA website; 2006-present on LexisNexis Academic Universe. This publication includes law review articles from other periodicals selected by students of the Williams Institute and the UCLA School of Law (LexisNexis).
  • Harvard Civil Rights-Civil Liberties Law Review (Harvard Law School). Location: 1966-2008 in Law Periodicals; 1966-present available on Hein Online; 2002-present available from Harvard website;1993-present available on LexisNexis Academic Universe.This law review has articles on the topic of civil rights. These will be on current topics and are primarily intended for scholars, students, and lawyers practicing within this area (LexisNexis).
  • Harvard Journal of Law & Gender (Harvard Law School). Location: 1978-present available on Hein Online; 2003 to present on Harvard website; 1993-present on LexisNexis Academic Universe. This law review has articles on issues relating to the law and women. These will be on current topics and are primarily intended for scholars, students, and lawyers practicing within this area.
  • Law & Sexuality: A Review of Lesbian, Gay, Bisexual and Transgender Legal Issues (Tulane University School of Law). Location: 1995-2005 in Law Periodicals; 1991-present available on Hein Online; 1996-present available on LexisNexis Academic Universe. This law review covers issues relating to the LGBT community. These will be on current topics and are primarily intended for scholars, students, and lawyers practicing within this area.

Online LGBT Legal Resources

  • Arizona by Lambda Legal. Lambda Legal is an LGBT legal advocacy organization. This page summarizes Arizona law with references/links to statutes, cases, and executive orders.
  • GLBTQ edited by Claude J. Summers & Ted-Larry Pebworth. This is a general encyclopedia of LGBT topics; it is good for an overview of a topic and may reference significant cases or laws.
  • Gay and Lesbian Rights by the American Civil Liberties Union. This is the ACLU’s section with news on LGBT civil rights issues and some materials on legal rights.
  • Gay and Lesbian Studies: Research Guide by the New York Public Library. This is an annotated guide to the materials at the New York Public Library with a section on “Legal, Social, And Behavioral Sciences” and “Selected Internet Sites.”
  • Gay, Lesbian, Bisexual, Transgender Studies: Library Research by the University of Arizona Library. This is a general unannotated LGBT research guide including materials at the UA library and some online resources.
  • Gay, Lesbian, Bisexual, & Transgender Studies: Selected Resources by the Princeton University Library. This is an unannotated guide to books and journals at Princeton’s library and online resources, with a section on “law and civil rights.”
  • Gay/Lesbian Law Pathfinder by Mark Plotkin (LLRX.com). This is an annotated pathfinder for LGBT legal issues created on July 27, 2007.
  • GayLawNet. This website has information on laws around the world, news archives, attorney listings, and links to other resources.
  • Immigration Equality. This is an organization that advocates for immigration equality and has information on current law.
  • Legal Resources: Sexual Orientation by the New England School of Law. This is an un-annotated list of online resources for LGBT legal issues.
  • National Center for Lesbian Rights. This is a legal advocacy group with information about issues and seeking legal assistance.
  • Service Members Legal Defense Network. This organization focuses on allowing LGBT members of the armed forces to serve openly by repealing “Don't Ask, Don't Tell” and providing legal services to armed forces personnel.
  • Sexual Orientation and the Law Research Guide at Cleveland-Marshall College of Law. This online research guide is directed at students working on a research paper. However, it does list a number of online resources relating to LGBT legal research.
  • Williams Institute at the UCLA School of Law. The Williams Institute focuses on sexual orientation law and public policy. Their site includes census information, bibliographic resources, and links to other online resources.

LGBT Family Law Resources

  • Adoption by Lesbians and Gay Men: an Overview of the Law in 50 States by Steven M. Tannenbaum (Lambda Legal Defense and Education Fund 1996). Location: KF 545 .Z95 T36 1996 (Law) —This is a brief overview of the status of adoption laws in the 50 states relating to gay & lesbian adoptions in 1996. It may be useful for historic research or as a starting point to find current law.
  • Arizona Family Law Rules Handbook by Mark W. Armstrong, et al. (Thomson/West 2007). Location: KFA 2494 .A29 W477 (Law Arizona Reserve) —This is an annotated collection of Arizona rules of procedure and evidence relating to family law cases.
  • Arizona Legal Forms: v. 4, Domestic Relations by Catherine A. Creighton (2nd ed., West Pub. Co. 1998). Location: KFA 2468 .A75 1997 v.4 (Law Arizona Reserve) —This book discusses the process of initiating domestic legal actions, the initial steps, and then many substantive topics. It is practical in nature and intended for both lawyers and non-lawyers. It includes many forms within the text and is updated with pocket parts.
  • Begin Researching: Family Law Research at the Daniel F. Cracchiolo Law Library. —This is the Cracchiolo Law Library’s links on family law, including two research databases (one is only accessible to UA law students/faculty) and two research guides.
  • Handling child custody, abuse, and adoption cases by Ann M. Haralambie (2nd ed., McGraw-Hill 1993). Location: KF 547 .H37 1993 (Law Reserve) —This book discusses child custody, abuse, and adoption in all states. It includes a section on adoption by unmarried parents. It is updated by a supplement.
  • Lesbians Choosing Motherhood: Legal Implications of Donor Insemination and Co-Parenting by Maria H. de Lamadrid (National Center for Lesbian Rights 1991). Location: KF 538 .L47 1991 (Law) —This book examines the legal issues surrounding all persons involved in an artificially inseminated child’s life. While it is older, the issues may be relevant and it could be a starting point for finding current law.
  • Living Together: a Legal Guide for Unmarried Couples by Toni Ihara, Ralph Warner, and Frederick Hertz (14th ed., Nolo Press 2008). Location: KF 538 .I35 2008 (Law Reference) —This is a self-help legal book written for the non-lawyer. It covers many legal issues relevant to non-married couples including agreements, debt, taxes, purchasing/renting homes, estate planning, family law, and more. It includes some sample forms at the end.
  • Living Together: Practical Legal Issues by Margaret C. Jasper (Oceana Publications, Inc. 2003). Location: KF 538 .Z9 J37 2003 (Law Ref.) —This is a self-help book written for non-lawyers. It discusses legal issues for non-married couples and has a chapter specific to same-sex couples. It is a few years old but could be a good starting point.
  • West's Arizona Family Law and Rules (West Pub. Co. annual). Location: KFA 2494 .A29 W47 (Law Reserve; Law Arizona Reference). This is a non-annotated collection of statutes and court rules in Arizona regarding family law.

Estate Planning

  • Drafting Effective Wills and Trusts by Steven D. Baker, Steven A. Bloom, and Mark A. Bregman (National Business Institute 2006). Location: KFA 2544 .B34 2006 (Law Arizona) —This book is written for the practicing attorney; however it has a list of estate planning tools, discussion of tax consequences, and checklists that may be useful for the non-lawyer.
  • Estate Planning Basics by Denis Clifford (4th ed., Nolo Press 2007). Location: KF 750 .Z9 C585 2007 (Law Reference) Also available online through the Cracchiolo Law Library. —This is a self-help book written for non-lawyers. It has an overview of the basics of estate planning such as beneficiaries, wills, trusts, taxes, and more.
  • Estate Planning for Same-Sex Couples by Joan M. Burda (ABA General Practice, Solo & Small Firm Section 2004). Location: KF 750 .B87 2004 (Law) —This is a guide to estate planning for same-sex couples that is not state-specific. Its intended audience is a practicing attorney but it has useful information for the non-lawyer including sample forms.
  • The Law of Trusts and Trustees by Amy M. Hess, George G. Bogert, and George T. Bogert (3rd ed., Thomson/West 2007). Location: KF 730 .B62 1977 2007 (Law) —This is a multivolume authoritative treatise on trusts. It is useful for finding detailed information on a specific issue within trust law.
  • Make your own Living Trust by Denis Clifford (8th ed., Nolo Press 2007). Location: KF 734 .Z9 C57 2007 (Online; Law Ref.) Also available online through the Cracchiolo Law Library. —This is a self-help book written for non-lawyers. It is an in-depth look at creating living trusts, one option for estate planning.
  • Page on the Law of Wills by William Herbert Page (1868-1952), William J. Bowe, and Douglas H. Parker (3rd ed., Anderson Pub. Co. 2003). Location: KF 755 .P3 1960 (Law) —This is a multivolume, authoritative treatise on wills. It is useful for finding detailed information on specific topics within the general subject of wills.
  • Plan your Estate by Denis Clifford (9th ed., Nolo Press 2008). Location: KF 750 .Z9 C59 2008 (Law Reference) —This is a self-help book written for non-lawyers. This is a more detailed look at estate planning, beginning with basic starting points and moving into specific tools, such as wills and trusts, and looking at family considerations, such as children, taxes, probate, and other topics.
  • Practical Guide to Estate Planning by Ray D. Madoff, Cornelia R. Tenney, and Martin A. Hall (CCH 2007). Location: KF 750 .P72 2008 (Law Reserve) KF 750 .P72 2007 (Law) —This book is written for lawyers and non-lawyers. It discusses the process of estate planning, tools such as wills and trusts, taxes, and other topics in fair depth.
  • Will and Trust Form Book by Schiff, Hardin & Waite (Bank One, Arizona, NA. 1993). Location: KFA 2544 .A65 B36 1993 (Law Arizona Reserve) —This is a collection of forms for wills, trusts, and related issues. The forms have comments next to them and labels for the different sections of the form.
  • A Will Is Not Enough In Arizona: Simple, Practical Things A Resident Of Arizona Can Do To Avoid Probate, Avoid Guardianship, Preserve Assets, Provide For Health Care, Provide For the Family's Care by Amelia E. Pohl and Dan R. Morris (Eagle Pub. 2003). Location: KFA 2540 .P65 2003 (Law Arizona Reference; Law Reserve) —This is a general guide to estate planning in Arizona. It is written for the non-lawyer.

Employment Discrimination

  • Arizona Employment Law Handbook edited by Thomas M. Rogers (State Bar of Arizona 2004). Location: KFA 2731 .A6 A7 (Law Arizona Reference; Law Reserve) This loose-leaf contains a compilation of Arizona laws relating to employment. It has a chapter on discrimination, which includes state and city laws.
  • Arizona Labor and Employment Law by John J. Balitis Jr., Kimberly A. Fatica, and Lawrence H. Lieberman (National Business Institute 1998). Location: KFA 2731 .Z9 B24 1998 (Law Arizona) —This is a process oriented book written for practicing attorneys, but useful for the non-lawyer.
  • Begin Researching: Labor & Employment Law Research at the Daniel F. Cracchiolo Law Library. —This is the Cracchiolo Law Library’s page on employment law with links to a number of databases (accessible only on campus or by UA law students/faculty) and two research guides.
  • Employment Discrimination by Lex K. Larson (Matthew Bender 2003). Location: KF 3464 .L37 1994 (Law) —This 11 volume loose-leaf service has in-depth information on the laws and processes relating to employment discrimination. It is useful for finding detailed information on specific topics. It was last updated in July of 2003, so statutes and cases will need to be checked for current applicability.
  • Employment Discrimination Law by Abigail Modjeska (3rd ed., Thomoson/West 2008). Location: KF 3464 .M6 1993 (Law) —This two volume loose-leaf service has fairly deep coverage of federal and state laws relating to employment discrimination, including constitutional considerations.
  • Employment Discrimination Reports (Bureau of National Affairs 2008). Location: Online - Law School BNA Electronic Subscription; Westlaw (BNA-EDR). —This is a source for news, information on new and pending cases, and pending regulations related to employment discrimination.
  • Employment Discrimination Verdicts and Settlements (Bureau of National Affairs 2008). Location: Online - Law School BNA Electronic Subscription. —This has jury verdicts and approved court settlements in employment discrimination cases, searchable by subject. It is useful for seeing the outcomes of similar cases.
  • The Essential Guide to Federal Employment Laws by Lisa Guerin and Amy DelPo (1st ed., Nolo Press 2006). Location: KF 3455 .Z9 G84 2006 (Law Reference) Also available electronically through the Cracchiolo Law Libraery. —This is a self-help book written for the non-lawyer. It focuses on federal laws relating to the rights of employees, including topics such as gender and the American’s with Disabilities Act.
  • Sexual Harassment in the Workplace: Law and Practice by Alba Conte (3rd ed., Panel 2000). Location: KF 3467 .C66 2000 (Law) —This two volume set, updated by supplement, discusses court process, administrative process, trials, employer defenses, and other topics of sexual harassment in employment.
  • Termination of Employment: Employer and Employee Rights by James Castagnera (Warren Gorham Lamont 1996). Location: KF 3471 .A6 T37 1996 (Law) —This is a two volume loose-leaf service that covers federal and state laws relating to the termination of employment. The index includes a listing for “sexual orientation.”
  • Unjust Dismissal by Lex K. Larson and Philip Borowsky (Matthew Bender 2003). Location: KF 3471 .Z95 L37 1985 (Law) —This five volume loose-leaf service covers federal and state laws relating to the unjust termination of employment. It was last updated in July of 2003, so statutes and cases will need to be checked for current applicability.
  • Your Rights in the Workplace by Barbara K. Repa (8th ed., Nolo Press 2007). Location: KF 3455 .Z9 R47 2007 (Law) Also available electronically through the Cracchiolo Law Library. —This is a self-help book written for non-lawyers. It discusses employee rights, with a brief mention of LGBT employees. It includes federal and state laws.
